Be It Enacted by the People of the State of Oregon:
SECTION 1. Section 2 of this 2019 Act is added to and made a part of the Oregon Vehicle Code.
SECTION 2. (1) As used in this section, “new vehicle” means a motor vehicle with 7,500 miles or less on the odometer when the vehicle is initially registered in this state.
(2) Notwithstanding any other provision of law, a person whose residence address is in a county with a population of 600,000 or more may not register a new vehicle in this state unless the vehicle is a new electric vehicle.
SECTION 3. Section 2 of this 2019 Act is amended to read:
Sec. 2. (1) As used in this section,
:
(a) “Level 4 highly automated vehicle” means a vehicle that:
(A) Is capable of completing an entire journey without driver intervention, even operating without a driver at all;
(B) Has some constraints, including but not limited to being confined to a certain geographical area or prohibited from operating beyond a certain speed; and
(C) May have provisions available for human operation in the vehicle such as a steering wheel or pedals.
(b) “Level 5 highly automated vehicle” means a vehicle that does not have any:
(A) Constraints on where the vehicle may operate or the speed at which the vehicle may travel; and
(B) Provisions for human operation in the vehicle such as a steering wheel or pedals.
(c) “New vehicle” means a motor vehicle with 7,500 miles or less on the odometer when the vehicle is initially registered in this state.
(2) Notwithstanding any other provision of law, a person whose residence address is in a county with a population of 600,000 or more may not register a new vehicle in this state unless the vehicle is a new :
(a) Electric vehicle ;
(b) Level 4 highly automated vehicle; or
(c) Level 5 highly automated vehicle .
SECTION 4. (1) Section 2 of this 2019 Act becomes operative on January 1, 2025.
(2) The amendments to section 2 of this 2019 Act by section 3 of this 2019 Act become operative on January 1, 2035.
