CHAPTER 468

AN ACT to amend the public health law and the education law, in relation to allowing pharmacies to electronically transfer prescriptions to other pharmacies

Became a law November 28, 2016, with the approval of the Governor.

Passed by a majority vote, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section 281 of the public health law is amended by adding a new subdivision 3-a to read as follows:

3-a. A pharmacy that receives an electronic prescription from the person issuing the prescription may, if the prescription has not been dispensed and at the request of the patient or a person authorized to make the request on behalf of the patient, immediately transfer or forward such prescription to an alternative pharmacy designated by the requesting party.

Section 2. Section 6810 of the education law is amended by adding a new subdivision 10-a to read as follows:

10-a. A pharmacy that receives an electronic prescription from the person issuing the prescription may, if the prescription has not been dispensed and at the request of the patient or a person authorized to make the request on behalf of the patient, immediately transfer or forward such prescription to an alternative pharmacy designated by the requesting party.

Section 3. This act shall take effect on the ninetieth day after it shall have become a law.
